Urban land-use planning for the town of Idar-Oberstein, Idar district;
Development plan I-28 "Vollmersbachtal II (center)" - 1st amendment;
Resolution on the preparation of the draft in accordance with Section 1 (3) and Section 2 (1) of the German Building Code (BauGB) and public participation in accordance with Section 3 (2) BauGB - draft open to the public
At its meeting on 11.12.2024, the city council of the city of Idar-Oberstein resolved to initiate the procedure for the 1st amendment to the development plan I-28 "Vollmersbachtal II (Mitte)" in accordance with Section 2 (1) BauGB.
In the course of the coronavirus pandemic, BioNTech was granted temporary approval for an office location in the form of container use on the municipal fairground on Vollmersbachstrasse. However, an extension for a further year can only be promised if the building planning law for the site is amended accordingly. However, as the site is not permanently required by the project developer, the office location is to be secured as a "research and development" special area until June 2030 at the latest. Following this, the area in question is to be returned to municipal use as a fairground in accordance with the provisions of development plan I-28 "Vollmersbachtal II (Mitte)" from 1985.
The planning area is centrally located between the two city centers of Idar and Oberstein and the districts of Göttschied and Regulshausen. The area to be planned for securing the office location includes part of the fairground in Vollmersbachstraße (parcel 47/61 from parcel 33 in the Idar-Oberstein district). It is wholly owned by the city of Idar-Oberstein. The development plan is not intended to change this ownership structure.
The scope of application covers an area of approx. 3,500 square meters and can be seen on the map below.

The development plan will be drawn up using the accelerated procedure in accordance with Section 13a in conjunction with Section 13 BauGB. § 13 BauGB.
The land use plan of the city of Idar-Oberstein shows the plan area as an area for public use with the purpose of "buildings and facilities serving cultural purposes". The preparation of the development plan is therefore not developed in part from the land use plan in accordance with Section 8 (2) BauGB. In this case, the land use plan can be adjusted by means of a correction in accordance with Section 13a (2) no. 2 BauGB; it should also be noted that, in accordance with the intended regulation, the representation of an area for public use will be applicable again from 01.07.2030.
In accordance with Sections 13a, 13 and 3 (2) BauGB, in the version published on November 3, 2017 (BGBl. p. 3634), which was last amended by Article 3 of the Act of December 20, 2023 (BGBl. 2023 I No. 394), public notice is hereby given that the draft development plan, consisting of the plan drawing and the text section together with the explanatory memorandum, will be published during the following period
from 07.04.2025 up to and including 12.05.2025
on the website of the city of Idar-Oberstein at
https://www.idar-oberstein.de/bekanntmachungen
and made available for viewing and downloading. The content of the announcement is also posted on the Internet.
The above-mentioned documents can also be inspected during the above-mentioned period at the Idar-Oberstein city administration, Stadtbauamt, Georg-Maus-Str. 1, 55743 Idar-Oberstein, room I.130, during general office hours (Monday to Friday from 8:30 to 12:00 and Monday, Tuesday and Thursday from 14:00 to 16:00).
The development plan fulfills the requirements to be carried out in accordance with Section 13a BauGB - inner development plans - in conjunction with Section 13 BauGB. § Section 13 BauGB to be implemented using the accelerated procedure. § Section 13 (2) and (3) BauGB apply accordingly. It should be noted that, pursuant to Section 13 (3) BauGB, an environmental assessment pursuant to Section 2 (4) BauGB, the environmental report pursuant to Section 2a BauGB, the information pursuant to Section 3 (2) sentence 2 BauGB on the types of environmental information available, the summary declaration pursuant to Section 10a (1) BauGB and, pursuant to Sections 13 (2) and 13a (3) BauGB, the early information and discussion pursuant to Sections 3 (1) and 4 (1) BauGB are waived.
Anyone can submit comments during the publication period. In accordance with Section 3 (2) sentence 4 no. 2 BauGB, comments should be submitted electronically where possible; this can be done by e-mail to the e-mail address: planung@idar-oberstein.de. It is also possible to submit comments in writing or for the record. The comments will be reviewed by the City Council. The result of the review will be communicated. In accordance with Sections 3 (2) and 4a (5) BauGB, comments that are not submitted on time may be disregarded when a decision is made on the development plan. Furthermore, it is pointed out that an application pursuant to Section 47 of the Administrative Court Code is inadmissible if it asserts objections that were not asserted by the applicant during the public inspection or were asserted late but could have been asserted.
Personal data is processed on the basis of Art. 6 (1) (e) of the General Data Protection Regulation (GDPR) in conjunction with Art. § Section 3 BauGB and the Rhineland-Palatinate State Data Protection Act.
